How long do I have to go to the CCMA?
If you were dismissed or treated unfairly at work, the law gives you a short time to refer the dispute to the CCMA or your bargaining council: generally 30 days for a dismissal and 90 days for unfair treatment. Tell us what happened and when, and we will show you the day that window generally ends.
Good to know
- The clock starts on the date of the dismissal, or the date of your employer's final decision if it held an appeal.
- Referring the dispute is not the same as winning it. It starts the process so your rights are protected.
- Some workers fall under a bargaining council instead of the CCMA. We will tell you which applies.
- Other time limits exist (for example for discrimination or unpaid wages). Ask us about yours.
