Consumer Protection Complaints

Defective goods a supplier will not replace or refund, unfair or misleading contract terms, or unsafe products — the Consumer Protection Act gives you real rights here, enforced through a complaint to the National Consumer Commission or, for some disputes, the National Consumer Tribunal.

What this involves

Tell us what you bought, what went wrong, and what the supplier has said so far.

The CPA's implied warranty against defects gives you the right to a repair, replacement, or refund (your choice, in most cases) for goods that fail within six months of delivery, without needing to prove the supplier was at fault — a right many suppliers do not volunteer, and one worth invoking directly by reference to the Act.

Unfair, unreasonable, or unjust contract terms — including terms buried in fine print that a consumer would not reasonably expect — can be challenged and set aside under the CPA, regardless of what the consumer signed.

Most disputes go first to the National Consumer Commission or an accredited industry ombud (motor, retail, etc.), and only escalate to the National Consumer Tribunal or the courts where that process does not resolve things — we work out the fastest effective route rather than defaulting to litigation.

How long does it take?

A National Consumer Commission complaint is typically resolved within 3 months. Where escalation to the Tribunal is needed, expect several months more.

R3 000 to R7 500 excl. VAT

Based on 2 to 5 hours of Attorney time at our rate of R1 500 per hour, excluding VAT.
